    Child Support and Visitation Attorney

Tampa Bradenton divorce and family lawEvery family situation is different when it comes to child support after a divorce. Obviously, the division of custody plays a major part in how much child support one parent will be required to pay to the other. The child’s future and well-being are the most important issues in determining the proper amount of child support to be paid. The courts do not view it as a burden or a punishment, but as support for your child’s life and happiness.

The Florida child support guidelines take into account the gross income of both parents. While the Court will typically award child support in accordance with the guidelines, Florida law does grant the Court the authority to deviate from child support guidelines if a child has special needs or if other extraordinary factors exist.

If you feel you are paying too much support or receiving inadequate support, We can review the facts of your case and help you determine if you have a basis to seek a child support modification. Factors that may warrant a child support modification include a job layoff, salary changes, or the increased needs of a minor child.

    Paternity and Parental Rights

If a mother is left to support and raise a child on her own, it stands to reason that a child support order would benefit her and her child. Additionally, the alleged father may have health insurance benefits that are available for the child.

Aside from the benefit of having a father’s involvement, a child may also be entitled to government benefits if the dad is disabled or a veteran. The child would also be entitled to inherit from the father’s estate.

Many men are becoming aware of the importance of a father in a child’s life. If the parents are not on good terms, the alleged father may need court orders for his share of parenting time. The father may want joint decision making authority with the mother. This means that the father and mother have an equal voice in decisions concerning the child’s health care, education and religious upbringing among other major issues. A father cannot obtain theses order without establishing his paternity.

The current law in Florida makes it quite clear that both parents should have continued contact with a minor child and that no presumption exists in favor of either parent in regard to parenting rights. Ideally, the parents will create a parenting plan that allows the child to spend as much time as possible with the father; however, if the parents are unable to reach an amicable agreement with regard to a parenting plan, the court will decide the terms of the plan. The plan of visitation should include liberal “time sharing” with the father unless good cause is shown why that is not in the child’s best interest.
